4/12/07 – Attorney Brian Allen Wins $500,000 Personal Injury Verdict from Maricopa County Jury

Brian Allen, a Mesa, Arizona, native, joined Udall, Shumway & Lyons, in 1996. Since joining the firm, Mr. Allen has continued in the firm’s over 40 year tradition of representing injury victims.  Mr. Allen’s practice focuses on protecting the rights of individuals who have been injured by the fault of others or by the abuses of insurance companies. His experience in injury and wrongful death litigation has included claims in such diverse areas as automobile, motorcycle, large truck and boat accidents, trip and fall incidents, and a wide variety of defective product cases. His experience also includes representation of individuals who have suffered injuries or death caused by medical negligence in various medical specialties including emergency medicine, obstetrics, laboratory, general surgery, ophthalmology, anesthesia, and others.

One of Mr. Allen's most satisfying areas of practice is insurance bad faith litigation. He has successfully brought claims on behalf of individuals against their own insurance companies to enforce policy provisions and to assist claimants in receiving the insurance benefits to which they are entitled.

Many of Mr. Allen’s clients are Spanish-speakers. Having lived in and/or spent significant time in both Puerto Rico and Mexico, he has developed a great interest and proficiency in the Spanish language and a desire to continue his relationship with the Spanish-speaking community. As a result, Spanish-speaking referrals are encouraged and appreciated.

Auto Accident Injury
Vera v. Lynch, CV2006-004113.  Lead trial attorney representing plaintiff who suffered significant back injury in motor vehicle accident.  Jury returned verdict in favor of plaintiff in an amount more than five times defendant’s best pre-trial offer.

Anderson v. Sanchez, CV2001-018544.  Lead trial attorney representing injured plaintiff through trial ending in plaintiff’s verdict.  In addition to damage award, plaintiff awarded more than $70,000 in attorneys’ fees as sanction against defendant.

Peterson v. Brown, CV2002-004168.  Lead trial attorney representing injured plaintiffs through trial ending in plaintiff’s verdict in an amount greater than defendant’s best pre-trial offer.

Medical Malpractice
Vance v Banner Health, CV2006-012948.  Served as lead attorney.  Confidential resolution.

Broyles v. VanderVeer, CV99-004428.  Served as trial attorney in three week medical malpractice trial ending in confidential settlement during jury deliberations.  Medical issues involved thyroid surgery mishap.

Threet v. Scottsdale Memorial Hospital, CV95-90580.  Served as trial attorney in wrongful death claim against hospital, radiologist, and OB/GYN.  Matter settled against some defendants and tried to jury verdict against others.  Medical issues involved failure to diagnose and treat placental abruption of pregnant female.

Insurance Coverage/Bad Faith
Goree v. Colorado Casualty.  Represented insureds in coverage dispute with automobile insurer.  Matter resolved following payment of claim by insurer.

Koldykowski v. Allstate, CV1999-090134 (CIV00-0419 PHS ROS) (Dist. Ariz.)  Represented surviving parents of daughter killed in automobile accident.  Insurance carriers for several defendants denied coverage based on residency issues.  Brought bad faith claims against several insurance companies and settled with insurance carriers after summary judgment in favor of plaintiffs.

Product Liability
White v. Southwest Gas Corp.  CV2004-091901.  Represented plaintiffs in property damage and personal injury claim arising out of defective gas line coupler which caused house fire.  Claim resolved through settlement following extensive litigation.

Williams v. Bridgestone/Firestone Inc., CV2001-012883.  Represented plaintiff in catastrophic injury case arising out of defective radial tire.  Case ended in favorable settlement with tire manufacturer.

Wilcox v. BLM Traders.  Represented plaintiff in serious injury case against manufacturer of electric scooter for defective brake design.  Case ended in favorable settlement for plaintiff.

Premises Liability
Cooper v. Destination PSM Hotel, Inc.  CV2006-004112.  Served as lead trial attorney representing catastrophically injured plaintiff who fell on a hidden step-off hazard in a hotel parking lot.  Following four day trial, jury returned verdict of $450,000 in favor of plaintiff, more than five times the defendants’ best pre-trial offer.  Matter settled during appeal.

Helquist v. Mountainbrook Golf Club, LLC, CV2004-090287.  Served as lead trial attorney representing injured plaintiff who tripped in erosion crevice on golf course and suffered torn rotator cuff.  Case litigated through jury verdict awarding plaintiff damages in an amount greater that defendant’s best pre-trial offer.

Michaels v. ABCO, CV98-045661 (Pinal County).  Served as lead trial attorney representing injured plaintiff who fell in grocery store.  Handled case through trial ending in plaintiff’s verdict in an amount greater than defendant’s best pre-trial offer.    

Wrongful Death
Hoopes v. Bowers.  Served as lead counsel representing surviving spouse and adult children in wrongful death claim against at-fault driver.  Matter settled prior to filing suit.

Knoll v. LA Fitness, CV2003-090820.  Served as lead counsel in wrongful death claim against fitness club for death caused by defective sauna.  Matter settled before trial.

Dram Shop (Alcohol Liability)
Meyers v. Desert Peaks Bar and Grill, CV2004-090795.  Represented young woman who suffered serious injuries following single car accident after having been over-served by liquor licensee.  Matter settled prior to trial.
