Managing Partner
Bradley D. Gardner is the Managing Partner of Udall, Shumway & Lyons and has practiced for nearly 30 years.  Mr. Gardner joined Udall, Shumway & Lyons in 2001 after 13 years as an Associate and Partner with a major regional law firm.

Mr. Gardner’s primary practice areas are employment law, personal injury and wrongful death, and commercial litigation. Much of his practice is devoted to representing municipal entities in these areas.

Employment law
Mr. Gardner’s employment practice includes both counseling clients on employment issues and litigation.  Mr. Gardner counsels with clients in the preparation of employee handbooks and manuals. Included in this practice is the implementation of drug testing policies and compliance with federal and state workplace laws. He also drafts and interprets restrictive covenant agreements and trade secret policies.  

In his litigation practice, Mr. Gardner represents employers defending against claims of discrimination, sexual harassment, unfair labor practices involving the NLRB, disputes relating to the Arizona wage law, the Fair Labor Standards Act, COBRA and ERISA.  Mr. Gardner has also defended employers in claims of defamation, invasion of privacy, fraud, negligent hiring and supervision, infliction of emotional distress and whistle blower claims.  He also defends municipal entities in the defense of Section 1981 and 1983 claims and First Amendment issues.  

Personal Injury and Wrongful Death
Mr. Gardner has litigated numerous cases involving personal injury and wrongful death. These cases have involved accidents involving the use or operation of automobiles, trucks and trailers,  motorcycles, motor homes and boats.

Mr. Gardner’s legal background makes him uniquely qualified to handle such cases. Acting as  Assistant General Counsel for U-Haul International early in his legal career, he represented the company in catastrophic injury and death claims throughout the United States.  In addition, prior to becoming a lawyer, he worked as an insurance company claims investigator. During his tenure, he investigated virtually all types of accident and injury claims on behalf of the insurance carriers.
 
Commercial Litigation
Mr. Gardner’s experience in commercial litigation includes the successful prosecution and defense of disputes relating to large and small  businesses, partnerships and corporations, construction disputes [including bond claims], the buying and selling of businesses, real estate and environmental issues, creditor/debtor disputes, and the representation of professionals, including attorneys, doctors, nurses and psychologists, in disagreements with their regulatory boards.
