Mr. Schwartz joined the firm in 1984 after serving as a law clerk to the Honorable Sarah Grant on the Arizona Court of Appeals, Division One.  Mr. Schwartz’s practice focuses on litigation of complex civil lawsuits before trial and appellate courts.

Employment Law
Mr. Schwartz’s employment law practice focuses on defense of litigation concerning civil rights, including alleged discrimination based upon race, national origin, sex, age and disability.  Mr. Schwartz typically represents governmental entities and their employees or former employees.

Litigation
Mr. Schwartz’s litigation practice addresses a wide variety of civil lawsuit issues including breach of contract, copyright infringement, intra company disputes,  real estate lien foreclosures, governmental bidding, and other disputes.

Representative Cases
Guthrie v. City of Scottsdale, U.S.D.C. CV 03-17279, Ninth Cir. 153 Fed. Appx. 987 (C.A. 9 2005).  Co-counsel representing municipality and employee sued for alleged retaliation for exercise of First Amendment right to free speech of assistant city attorney.  As counsel obtained summary judgment for municipality and employee in trial court, which decision was upheld after oral argument by the Ninth Circuit Court of Appeal. 

No Time, Inc. v. Arizona Department of Revenue, Tx 03-000252, 2005 WL 4891675 (Ariz. App. 2005).  Counsel representing taxpaying company challenging imposition of transaction privilege tax to certain operations of company.  As counsel obtained summary judgment for company in trial court, which decision was upheld after oral argument by the Arizona Court of Appeals, Division One.
