Question:
I’ve already settled on the amount for an automobile accident that I was involved in and I was told that it should not take more then a month to receive the check. It has been almost 6 weeks and I’ve not yet received anything. Can you tell me what might cause the slowdown? Am I entitled to the accumulation of interest after a certain number of days?
Answer:
It should not take six weeks to get a settlement check. A person in your situation, who already has an attorney, should discuss with him/her the options available, which might include filing a lawsuit for breach of the settlement agreement. If the settlement agreement is confirmed in writing, a party may be entitled to interest and attorneys fees. The best course of action is to talk to the lawyer about enforcing the existing settlement agreement.
