When you are married, the filing of bankruptcy protection creates an estate of all community property. As such, if you file bankruptcy and your spouse does not, you and your spouse will both have to send at least a portion of your income tax refunds to the Trustee for disbursement to your creditors, even if your spouse filed taxes separately. The amount you will be required to send depends on when you file.
