When considering filing for bankruptcy, you will need to complete a Means Test. The Means Test is a formula used to analyze your income and expenses to determine if you qualify to file a Chapter 7 or if you must file Chapter 13. We look at your average income for the 6 months prior to filing and compare it to the median income for the State of Arizona. If your income is below the median, then you may choose Chapter 7. If your income is above the median, then the remaining information in the Means Test is applied to determine whether you can file a Chapter 7 or 13. The Means Test can be complicated and convoluted. In order to understand how it applies to you, it is best to seek legal counsel that is competent in such matters.
