There are several factors considered in granting immigration status. Thousands of people wish to come to the United States every year; many with hopes of seeking immigration status. Indeed immigration status affords many opportunities for immigrants and their families. However, applicants must meet the criteria necessary to file for an immigration visa. The criterion varies, depending on the type of visa you are seeking. Once you are ready to move forward with a visa application, you need to prepare with the documentation and other data that must be provided as part of the approval process.

Factors USCIS Considers

The USCIS, United States Citizenship and Immigration Services, considers a number of different factors when granting immigration status. Some of these factors include:

  • If the applicant has an immediate family member who is a current U.S. citizen
  • The type of employment opportunities available to the applicant
  • Applicant education and skills helpful in finding a job
  • Investments (Capital) in the United States that are beneficial to the economy
  • If the applicant qualifies for refugee status

The applicant should review all the various types of visas that are available to determine which visa would be the best option. These issues should be discussed with an experienced immigration attorney prior to the start of the application process.

Green Card Lottery

The USCIS offers a number of visas to immigrants each year through a lottery system. The lottery allows immigrants from particular countries, or those with special exceptions, the ability to achieve a visa more quickly and easily. There is a list of countries from which the green card lottery accepts applicants. If you fall into one of these special groups, it may be beneficial to try getting a visa through the lottery. However, it is important to note that you must apply by a specific deadline and only a specific number of visas are allowed through this method. If you are not picked through the lottery, you will have to figure out an alternative means to obtain lawful status in the United States.

Preparing for Immigration

There are some steps that you need to take to prepare for a visa. Before you submit a visa application, it is advisable that you speak with a qualified immigration attorney to learn the details of the information that you will have to submit. For example, if you plan on applying for a visa based on marriage to a U.S. citizen, you will have to gather and provide supporting documentation that proves the marriage is real. Depending on the type of visa requested, you must provide data required.
